Opinion

CASE NO. 727 CRD-7-88-4

OCTOBER 4, 1989

The claimant was represented by Kenneth A. Votre, Esq., and Richard L. Jacobs, Esq., both of Jacobs, Votre Jacobs.

The respondents were represented by Jason Dodge, Esq., Pomeranz, Drayton Stabnick.

This Petition for Review from the April 12, 1988 Finding and Dismissal of the Commissioner for the Seventh District was heard June 23, 1989 before a Compensation Review Division panel consisting of the Commission Chairman, John Arcudi, and Commissioners Robin Waller and Andrew Denuzze.

OPINION

A Voluntary Agreement executed and approved March 7, 1983 indicated claimant suffered a compensable injury to his neck and back May 23, 1979. The claimant seeks additional compensation for total disability. The Seventh District April 12, 1988 Finding and Dismissal denied continued temporary total benefits.

Claimant argues on appeal that transcripts of the formal hearings below contain "deletions, garbled translations and completely blank entries." He, therefore, argues that the matter must be remanded. We agree. Without the preparation of an accurate and complete record of the proceedings below proper review is impossible, Sorbello v. Gagnon, 6 Conn. Workers' Comp. Rev. Op. 3, 567 CRD-6-87 (1988). If possible the record of the proceedings below should be more accurately transcribed. If an accurate more complete record cannot, be prepared the matter may have to be reheard.

The matter is remanded for further proceedings consistent with this opinion.

Commissioners Robin Waller and Andrew Denuzze concur.
