PHILLIP MICHAEL CARTER, Appellant v. THE STATE OF TEXAS, Appellee

On Appeal from the 296th Judicial District Court Collin County, Texas Trial Court Cause No. 296-83865-2018

ORDER

NANCY E. KENNEDY JUSTICE

The reporter's record is overdue. The record was due July 23, 2022. On October 31, 2022, the court reporter requested an extension of sixty days to prepare the reporter's record, stating that the size of the record and her schedule necessitated the 60-day extension. On November 2, 2022, we granted the motion in part, ordering the record be filed by December 16, 2022, and stating that the Rules of Appellate Procedure limit the length of each extension to file the record to thirty days. See Tex. R. App. P. 35.3(c). The reporter's record for this case has not been filed even though more than sixty days have passed since the court reporter requested a sixty-day extension. Accordingly, we ORDER Stephanie Moses, court reporter, file the reporter's record no later than FEBRUARY 8, 2023. Ms. Moses is cautioned that if the reporter's record is not filed by February 8, 2023, the Court may abate this appeal and order the trial court to make findings and recommendations regarding why the reporter's record has not been filed.

We DIRECT the Clerk to send copies of this order to Stephanie Moses, court reporter, and to counsel for all parties.
