ROBERT D. BURNS, III, CHIEF JUSTICE

The reporter's record in this case is overdue. It was requested December 29, 2022, and first due February 6, 2023. On February 8, 2023, when it had not been filed, we notified Janet E. Wright, the Official Court Reporter for County Court at Law No. 3, that it was overdue and directed her to file it within thirty days. When the record had not been filed by March 24, 2023, we again notified Ms. Wright that the reporter's record was overdue and ordered her to file it within fifteen days. To date, Ms. Wright has not complied and by motion filed April 26, 2023, appellant requests we take "appropriate action."

We GRANT appellant's motion TO THE EXTENT THAT we ORDER Ms. Wright to file the record no later than May 12, 2023. We expressly CAUTION Ms. Wright that failure to comply with this order may result in an order that she not sit as a court reporter until she complies.

We DIRECT the Clerk of the Court to send a copy of this order to the Honorable Sally Montgomery, Presiding Judge of County Court at Law No.3; Ms. Wright, and, the parties.
