JUDGMENT

It is ORDERED, ADJUDGED and DECREED that:
1. Petitioner's application for writ of habeas corpus should be dismissed in part and denied in part.
2. The Clerk shall transmit a true copy of this Order and the Order adopting the Findings and Recommendation of the United States Magistrate Judge to all parties.
