The reporter's record is overdue. The record was originally due June 9, 2023. On June 13, 2023, we notified Karla Kimbrell, Official Court Reporter for the 380th Judicial District Court, that the reporter's record was overdue and directed her to file the reporter's record within thirty days, that is, by July 13, 2023. On July 5, 2023, in an order reinstating the appeal following an abatement, we stated that the reporter's record was due July 13, 2023. As of the date of this order, the reporter's record has not been filed. Accordingly, we ORDER Karla Kimbrell, Official Court Reporter for the 380th Judicial District Court, to file the complete reporter's record for this appeal on or before SEPTEMBER 6, 2023. We caution Ms. Kimbrell that should she fail to file the complete reporter's record within the time stated, the Court will utilize whatever remedies it has available, which may include ordering that Ms. Kimbrell not sit as a court reporter until she files the complete reporter's record in this appeal.
We DIRECT the Clerk to send copies of this order to the Honorable Benjamin N. Smith, Presiding Judge, 380th Judicial District Court; Karla Kimbrell, Official Court Reporter for the 380th Judicial District Court; and counsel for all parties.
