MEMORANDUM AND ORDER


This matter is before the court on its own motion. Now that the motions for summary judgment have been resolved, the matter must be scheduled for trial. At the time of the last progression order, filing 44, May 6, 2004, it was anticipated that the case could be readied for trial in October, 2004. Much has happened since that time, and that schedule was abandoned. I shall reinstate the case to a similar schedule now.

IT THEREFORE HEREBY IS ORDERED,

The order of May 6, 2004, filing 44, is reinstated with the following amendments:

a. The deposition deadline is now August 10, 2005, and all deadlines based on the deposition deadline are extended accordingly.
b. The final pretrial conference is set for 9:00 a.m., on August 24, 2005 in the chambers of the undersigned.
c. Jury trial is set to commence at 9:00 a.m., on September 12, 2005 for a duration of five trial days before the Honorable Richard G. Kopf in Courtroom 1, United States Courthouse and Federal Building, 100 Centennial Mall North, Lincoln, Nebraska. Trial is subject to the prior disposition or continuance of any criminal matters which may be set for that week. Jury selection will be held at commencement of trial.

In all other respects the provisions of the May 6, 2004 progression order remain in effect.
