Appellant having moved for an extension of time to perfect the appeal taken herein from a judgment of the Supreme Court entered in the Office of the Clerk of the County of Erie on January 3, 2013,

Now, upon reading and filing the affidavit of Steven E. Peiper, Esq., sworn to June 24, 2013, the notice of motion with proof of service thereof, and the affidavit of Timothy G. O'Connell, Esq., sworn to July 2, 2013, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is granted to the extent that the first ordering paragraph of the order of this Court entered April 25, 2013, is hereby amended by deleting the date June 24, 2013, and inserting in its place the date August 23, 2013.
