Upon consideration, respondent's motion to dismiss appeal as premature or alternatively relinquish jurisdiction to the trial court to enter order addressing all claims is denied.

The petition for writ of habeas corpus is dismissed. ROTHENBERG and EMAS, JJ., concur.

SCHWARTZ, Senior Judge, would carry the motion to dismiss with the case.
