Marc A. Capodici Petitioner v. Commissioner of Internal Revenue Respondent

ORDER

Maurice B. Foley Chief Judge

On January 5, 2021, respondent filed a motion to dismiss for lack of jurisdiction on the ground that the petition was not filed within the time prescribed by the Internal Revenue Service. In response to that motion, on March 17, 2021, a letter dated March 10, 2021, was filed by attorney James Daloisio on behalf of petitioner. While Mr. Daloisio is admitted to the Tax Court bar, he neither signed the petition filed to commence this case nor entered an appearance in this case. Accordingly, we will strike his letter filed March 17, 2021, from the Court's record.

Upon due consideration, it is

ORDERED that the above-referenced letter, filed March 17, 2021, is stricken from the Court's record in this case.
