CAPO v. BERG

Supreme Court of Florida
Feb 19, 2009
1 So. 3d 171 (Fla. 2009)

Opinion

No. SC08-2279.

February 19, 2009.

Lower Tribunal No(s). 3D05-1354, 3D05-2004.

Petitioner has submitted a "Petition for Writ of Prohibition and/or Mandamus" which this Court has treated as a petition for writ of mandamus. Because petitioner has failed to show a clear legal right to the relief requested, he is not entitled to mandamus relief. Accordingly, the petition is hereby denied. See Huffman v. State, 813 So. 2d 10, 11 (Fla. 2000).

PARIENTE, LEWIS, CANADY, POLSTON, and LABARGA, JJ., concur.
