Appeal from an order of the Civil Court of the City of New York, Queens County (Carmen R. Velasquez, J.), entered March 18, 2009. The order denied defendant's motion to dismiss the complaint.

ORDERED that the order is affirmed without costs.

For the reasons stated in RAB Performance Recoveries, LLC v Harari, ___ Misc 3d ___, 2010 NY Slip Op ______ [Appeal No. 2009-1548 K C], decided herewith), the order denying defendant's motion to dismiss the complaint is affirmed.
