ORDER

Kathleen Jansen Presiding Judge.

The motion to waive fees is GRANTED for this case only.

The application for leave to appeal is DENIED for lack of merit in the grounds presented.

The motion for punitive damages is GRANTED in part. The application grossly disregarded the requirements of a fair presentation of the issues to the Court under MCR 7.216(C)(1)(b) and warrants an award of actual damages and expenses incurred by appellee in responding to the vexatious application for leave to appeal, including reasonable attorney fees. The matter is REMANDED to the 41-B District Court for determination of the amount of actual damages. MCR 7.216(C)(2).

The motion for bond is DENIED.
