BRENDA CAMPBELL v. GEICO CASUALTY COMPANY


In Re: GEICO Casualty Company, applying for supervisory writs, 18th Judicial District Court, Parish of Pointe Coupee, No. 46089. BEFORE: McDONALD, McCLENDON, AND THERIOT, JJ.

WRIT GRANTED. The September 1, 2015 ruling of the trial court denying relator's motion for summary judgment is reversed and the motion is granted dismissing with prejudice plaintiff's non-contact UM claim. Under the specific facts of this case, we find that Joshua Campbell, plaintiff's husband, is not an "independent and disinterested" witness under La. R.S. 22:1295.
