Gary A. CAMPBELL, Appellant v. Deborah S. CARRASCO, Appellee

From the 37th Judicial District Court, Bexar County, Texas

Trial Court No. 2013-CI-01147

Honorable Michael E. Mery, Judge Presiding

ORDER

The trial court clerk filed a notification of late record stating that the clerk's record has not been filed because appellant has failed to pay or make arrangements to pay the fee for preparing the record and that appellant is not entitled to appeal without paying the fee. On May 29, 2013, this court issued an order construing a document filed by appellant as an affidavit of indigence and ordering any contest to the affidavit to be filed by June 10, 2013. No contest was filed; accordingly, appellant's allegations are deemed to be true, and appellant is entitled to appeal without paying the fee for the preparation of the clerk's record. See TEX. R. APP. P. 20.1(f). The clerk's record must be filed in this appeal no later than twenty days from the date of this order.
