It is ordered that the opinion filed in this case on May 30, 2008 (163 Cal.App.4th 566;___Cal.Rptr.3d___), be modified as follows, and the petition for rehearing is DENIED:

On page 7, line 8 of the second full paragraph, [163 Cal.App.4th 572, advance report, 6th full par., line 7], replace $2,424,000 with $3,271,488, so the line reads:

$3,271,488, with interest at the rate of 10 percent from the date

This modification does not change the judgment.
