MEMORANDUM OPINION


Garnet Gordon Cameron was convicted of theft of property valued at $500 or more but less than $1500 by a public servant. See Tex. Penal Code Ann. §§ 31.03(e)(3), (f)(1) (Vernon Supp. 2008). On December 5, 2008, the trial court assessed punishment at two years' imprisonment in a state jail facility, probated for three years, and a $2500 fine. Appellant did not file a motion for new trial; therefore his notice of appeal was due by Monday, January 5, 2009. See Tex. R. App. P. 4.1(a), 26.2(a)(1). Appellant's March 30, 2009 notice of appeal is untimely, leaving us without jurisdiction. See Slaton v. State, 981 S.W.2d 208, 210 (Tex.Crim.App. 1998) (per curiam); Boyd v. State, 971 S.W.2d 603, 605-06 (Tex.App.-Dallas 1998, no pet.). Accordingly, we dismiss the appeal.
