The Court states its tentative views that it is inclined to grant-in-part and deny-in-part Plaintiff's Motion to Remand at Dkt. 10 (the “Motion”). The Court is inclined to dismiss without prejudice the fifth, sixth and seventh causes of action as pre-empted and remand the remaining four causes of action. Counsel address the Court. The Court takes the Motion UNDER SUBMISSION and a ruling will be issued.
The Court inquires whether settlement efforts at this time would be productive. Counsel state their willingness to meet and confer on the issue.
