ORDER

LEWIS KAPLAN, District Judge

Based on the representation by counsel for defendant Consolidated Edison Company of New York, Inc. ("ConEd") in today's telephone conference with her and plaintiff's counsel that ConEd will pay the agreement settlement in exchange for plaintiff's release, without insisting upon additional terms or writings, plaintiff's motion to enforce the settlement is denied without prejudice to renewal in the event the settlement is not consummated on or before June 16, 2005.
