This case was calendared for trial during the Court's March 7, 2022, Dallas, Texas, trial session. On February 22, 2022, petitioners filed a Motion to Change Place of Trial to Fresno, California. On February 22, 2022, the Court held a conference call with the parties to discuss the current status of the case and petitioners' pending motion. On February 24, 2022, the Court held a follow-up conference call with the parties and Robert Probasco, Director of the Low-Income Taxpayer Clinic at Texas A&M University School of Law, who at the conclusion of the call agreed to represent petitioners. By Order served February 25, 2022, among other things, this case was stricken from the March 7, 2022, Dallas, Texas, trial session and the parties were directed to file either a joint status report or stipulated decision document on or before April 25, 2022.
On April 25, 2022, the parties filed a Joint Status Report (Doc. 41) informing the Court that the Texas A&M University School of Law who agreed to represent petitioners has made progress and begun obtaining documents and conducting legal research concerning the issues. The report further states that the clinic will have no students participating over the summer and that the parties anticipate that any outstanding issues will be resolved in the fall.
Upon due consideration, it is hereby
ORDERED that, on or before September 27, 2022, the parties shall file with the Court either a joint report (or, if that is not expedient, then separate reports) describing the status of the case or a stipulated decision document.
