Pursuant to Federal Rule of Civil Procedure 41(a), Plaintiff Cable Wireless Internet Services, Inc. ("CWIS") and Defendant Akamai Technologies, Inc. ("Akamai") hereby stipulate that the complaint and counterclaim, and all claims and counterclaims asserted in the above-referenced action by and between CWIS and Akamai be dismissed without prejudice. Each party shall bear its own fees and costs with respect to this action.

IT IS SO ORDERED.
