On March 16, 2020, due to concerns relating to coronavirus (COVID-19), the trial session scheduled to begin in Niagara Falls, NY (Buffalo, NY) on April 6, 2020, was canceled, and this case was assigned to this Division of the Court. As directed by the Court, respondent filed a Status Report on November 29, 2021, advising that the parties are working together to narrow the issues or reach a resolution. Upon due consideration and for cause, it is hereby

ORDERED that, on or before January 31, 2022, the parties shall file further status reports regarding the then-present status of this case.
