On order of the Court, the application for leave to appeal from the March 27, 2001 decision of the Court of Appeals is considered, and it is DENIED, because we are not persuaded that the questions presented should be reviewed by this Court.

Cavanagh, J., would remand the case to the Court of Appeals for consideration as on rehearing granted in light of Lugo v Ameritech Corp Inc, 464 Mich. 512 (2001).

Kelly, J., would grant leave to appeal.
