Butler v. State

District Court of Appeal of Florida, Fourth District
Jan 23, 1991
572 So. 2d 1038 (Fla. Dist. Ct. App. 1991)

Opinion

No. 89-2681.

January 23, 1991.

Appeal from the Circuit Court for Broward County; Patti Englander Henning, Judge.

Richard L. Jorandby, Public Defender, and Louis G. Carres, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Atty. Gen., Tallahassee, and Deborah Guller, Asst. Atty. Gen., West Palm Beach, for appellee.

AFFIRMED.

LETTS and STONE, JJ., concur.

GLICKSTEIN, J., dissents with opinion.

I would reverse the trial court's revocation of appellant's probation and entry of judgment and sentence and find that the state failed to present any evidence demonstrating that appellant willfully refused to comply with the conditions.
