For the reasons assigned in the opinion this day handed down in the consolidated cases of Acosta v. Smith et al., and Butler v. Smith, 23 So.2d 742.

It is ordered that the judgment herein appealed from be and the same is hereby affirmed at the cost of the plaintiffs in both courts.
