No. 05-07-00119-CV (Tex. App. Mar. 9, 2007)

Opinion

No. 05-07-00119-CV

Opinion Filed March 9, 2007.

On Appeal from the 116th Judicial District Court, Dallas County, Texas, Trial Court Cause No. 06-09425-F.

Before Justices, WHITTINGTON, FRANCIS, and LANG.

MEMORANDUM OPINION

On January 30, 2007, appellants filed a notice of appeal in this case indicating they were appealing the trial court's January 23, 2007 "order granting defendant's motion to transfer venue." By letter dated February 7, 2007, we directed appellants to file a letter brief regarding this Court's jurisdiction. Appellants responded, but their letter brief fails to explain how this Court has jurisdiction over this appeal.

Appellate courts have jurisdiction over final judgments and such interlocutory orders as the legislature deems appealable. Lehmann v. Har-Con Corp., 39 S.W.3d 191, 195 (Tex. 2001); Ruiz v. Ruiz, 946 S.W.2d 123, 124 (Tex.App.-El Paso 1997, no writ). An order transferring venue is not an appealable interlocutory order. See Tex. Civ. Prac. Rem. Code Ann. § 15.064(a) (Vernon 2002).

Accordingly, we dismiss this appeal for want of jurisdiction.
