Appeal pursuant to Fla.R.App.P. 9.141(b)(2) from the Circuit Court for Pinellas County; Richard A. Luce, Judge.


Daniel Burton appeals the summary dismissal of his motion for postconviction relief filed pursuant to Florida Rule of Criminal Procedure 3.850. We affirm the postconviction court's dismissal of Mr. Burton's motion without prejudice for Mr. Burton to refile a timely, facially sufficient rule 3.850 motion.

Affirmed.
