STIPULATION AND [PROPOSED] ORDER FOR DISMISSAL OF FEDERAL CLAIM AND REMAND


Plaintiff Jeremy Burke hereby requests that Case No. C-02-3882 SI be dismissed with prejudice in its entirety. Plaintiff further stipulates that Case No. C-02-4311 SI does not allege any federal claims or seek relief under federal law. On the ground that Case No. C-02-4311 SI does not raise any federal questions, plaintiff further requests that Case No. C-02 4311 SI be remanded to the Superior Court of the State of California, in the City and County of San Francisco. Defendants have no objection to these requests.

ORDER

Good cause shown, it is hereby ordered that:

1. Case No. C-02-3882 SI be and hereby is DISMISSED WITH PREJUDICE.

2. Case No. C-02-4311 be and hereby is REMANDED.

All parties shall bear their own costs to date.
