CHARLES BUERGER, Appellant v. DIGITAL SIGNS WIZARDS, INC., NATHEER RAMADNEH, AND BASSAM BALSHA, Appellees

On Appeal from the 284th District Court Montgomery County, Texas
Trial Cause No. 15-05-04728-CV

MEMORANDUM OPINION

Appellant Charles Buerger filed a motion to dismiss this accelerated interlocutory appeal because the trial court has called the case to trial, thereby rendering the appellate issues moot. The Court finds that the motion is voluntarily made by the motion of the appellant prior to any decision of this Court and should be granted. See Tex. R. App. P. 42.1(a)(1).

It is, therefore, ORDERED that the motion to dismiss is granted and the appeal is DISMISSED without reference to the merits of the appeal. Appellate costs are assessed against the appellant.

APPEAL DISMISSED.
