Budna v. Kowalska

Appellate Division of the Supreme Court of New York, Second Department
Sep 1, 1931
234 App. Div. 629 (N.Y. App. Div. 1931)

Opinion

September, 1931.

Judgment dismissing complaint as against defendant Czeslawa Kowalska reversed upon the law and the facts and a new trial granted, costs to abide the event. We think a new trial is required in the interests of justice. The findings of fact contained in the so-called conclusion of law numbered third are reversed. Lazansky, P.J., Young, Kapper, Scudder and Tompkins, JJ., concur.
