Upon review of petitioner's response to this Court's order to show cause dated September 25, 2008, the Court has determined that it should decline to accept jurisdiction in this case. See D.B. v. State, No. SC08-834, 2008 WL 4292670 (Fla. Sept. 18, 2008) (table) (denying review of D.B. v. State, 979 So. 2d 1119 (Fla. 3d DCA 2008)). The petition for discretionary review is therefore denied.

No motion for rehearing will be entertained by the Court. See Fla.R.App.P. 9.330(d).

Petitioner's "Motion for Leave to Serve/File Late Brief on Jurisdiction" is hereby denied as moot.
