On Appeal from the County Criminal Court No. 5 Dallas County, Texas Trial Court Cause No. MB21-42125-F

ORDER

ROBERT D. BURNS, III CHIEF JUSTICE

We REINSTATE this appeal.

On June 30, 2023, we abated this case for the trial court to hold a hearing and determine whether the jury charge on punishment had been lost or destroyed. On July 13, 2023, the Court received a supplemental clerk's record containing the jury's verdict on punishment, and on July 24, 2023, the Court received a supplemental clerk's record containing the jury charge on punishment. Accordingly we VACATE our order of June 30, 2023, and the trial court need not hold the hearing or prepare the findings required by that order.

We DIRECT the Clerk to send copies of this order to the Honorable Lisa Green, Presiding Judge, County Criminal Court No. 5, Dallas County; John Warren, Clerk of the County Criminal Courts of Dallas County, Texas; and counsel for all parties.
