PRESENT:

Petitioner having moved for permission to proceed as a poor person on this CPLR article 78 proceeding transferred to this Court by an order of the Supreme Court entered in the Office of the Clerk of the County of Oneida on July 2, 2016, and for permission to file a late notice of appeal,

Now, upon reading and filing the affidavit of Nathan Brown sworn to February 11, 2016, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED that the motion is dismissed as unnecessary, and petitioner may proceed pursuant to 22 NYCRR 1000.8.
