Brown v. Jury

Court of Appeal of Louisiana, Second Circuit
Dec 22, 2010
56 So. 3d 1052 (La. Ct. App. 2010)

Opinion

No. 45, 851-WCA.

December 22, 2010.

Appeal from the Office of Workers' Compensation, District IE, Ouachita Parish, Brenza Irving Jones, J.

Snellings, Breard, Sartor, Inabnett Trascher, LLP by Michael Creighton, Monroe, LA, for Defendant-Appellant.

Law Offices Of Raymond Lee, Cannon, LLC by Raymond Lee Cannon, Tallulah, LA, for Plaintiff-Appellee.

Before STEWART, GASKINS and DREW, JJ.

STEWART, J., concurs.

I would affirm this matter and not amend to limit the employer's payment of the MRI to $750.00. Under La.R.S. 23:1310.8 and the compelling facts of the claimant's inability to find a doctor who would accept the workers' compensation payment, an exception is justified. I would affirm across the board.
