RICARDO BROWN & JUDY NILLA WANJUGU, Petitioners, v. COMMISSIONER OF INTERNAL REVENUE, Respondent

ORDER

Robert N. Armen, Jr. Special Trial Judge

On October 7, 2016, petitioners filed a Motion To Dismiss and recited therein that counsel for respondent has no objection to the granting of the motion. Petitioners ask for dismissal of their case based on the fact that they have submitted an offer-in-compromise and that their offer is presently under review by one of respondent's offer specialists. It is possible that petitioners' offer will ultimately be accepted by respondent, but until then, it is not appropriate to dismiss this case. In order to preserve petitioners' right to proceed should their circumstances warrant, it is

ORDERED that petitioners' aforementioned motion is granted in that this case is stricken for trial from the Court's October 17, 2016 Washington, D.C. trial session and continued generally. Accordingly, petitioners need not appear in court on October 17, 2016.
