ORDER OF PARTIAL DISMISSAL


Based upon the United States of America's Motion for Partial Dismissal (with attachments), good cause appearing therefore, pursuant to Rules 41(a) and 41(c) of the Federal Rules of Civil Procedure, and being fully advised in the premises;

IT IS HEREBY ORDERED that the United States of America's Motion for Partial Dismissal should be, and is hereby, GRANTED.

IT IS FURTHER ORDERED that the claims and causes of action asserted in the Amended Answer, Counterclaim and Third-party Complaint (Docket No. 9) against the Third-party Defendants Neil F. Boel and Karen S. Boel, husband and wife ("Boels"), Richard Lee Kaylor and Gloria J. Kaylor, husband and wife ("Kaylors"), and World Savings and Loan, should be, and are hereby DISMISSED WITH PREJUDICE, with the parties to bear their own costs and fees relating to said claims and causes of action.
