ORDER


Pending before the Court in the above-entitled matter is Defendant Bureau of Reclamation's Motion to Dismiss Plaintiff's Amended Complaint (Docket No. 84). The Court has been advised by Defendant's counsel that the matter has been mediated and appears to be resolved. However, settlement documents are still being finalized and executed.

Based on the representation of settlement, this Court will DENY WITHOUT PREJUDICE the pending motion. If the parties are unable to finalize their settlement, the Defendant is granted leave by the Court to renew its motion for dismissal.

SO ORDERED
