Case No. C-2-01-471 (S.D. Ohio Jul. 16, 2002)

Opinion

Case No. C-2-01-471

July 16, 2002

Daniel Karl Friend, Columbus, OH, Attorney for Plaintiff.

Elizabeth Thym Smith, Vorys Sater Seymour Pease — 2, Columbus, OH, Attorney for Defendants.

ORDER

Plaintiff Annie C. Brower discharged her trial attorney, Daniel K. Friend, and his co-counsel, David M. Bidwell. On March 28, 2002 the Court filed an Order requiring plaintiff to either retain new counsel who entered his or her appearance as her trial attorney within thirty days or, if she did not retain new counsel by then but intended to continue to prosecute her claims, she had to file a notice with the Court within the same thirty days stating her intent to represent herself. She has failed to do either.

On May 24, 2002 the Court ordered plaintiff Annie C. Brower to show cause within thirty (30) days of the date of the Order why this case should not be DISMISSED for failure to comply with the Court's March 28, 2002 Order and for failure to prosecute her claims. She failed to respond to the May 24, 2002 Order.

Accordingly, the Clerk of Court is DIRECTED to enter JUDGMENT dismissing this case for failure to prosecute and for failure to comply with orders of the court.
