ORDER ACCEPTING FINDINGS AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE


On February 27, 2003, United States Magistrate Judge Jeff Kaplan made Findings and a Recommendation. No objections were filed. The Court thus reviews the Findings and Recommendation for plain error. Finding no plain error, the Court accepts the Findings and Recommendation of the United States Magistrate Judge.

IT IS THEREFORE ORDERED that the Findings and Recommendation of the United States Magistrate Judge are accepted.

JUDGMENT

The Court has entered its Findings in the case, accepting the Findings and Conclusions of the Magistrate Judge. Therefore,

It is ORDERED, ADJUDGED and DECREED that petitioner's application for writ of habeas corpus is DISMISSED as duplicative.

It is further ORDERED that the Clerk shall transmit a true copy of this Judgment, together with a true copy of the Order Accepting the Findings, Conclusions, and Recommendation of the United States Magistrate Judge, to the parties.
