         On discretionary review pursuant to N.C.G.S. § 7A-31 of a unanimous decision of the Court of Appeals, __ N.C.App. __, 679 S.E.2d 507 (2009), dismissing plaintiff's appeal from a judgment and order entered on 3 June 2008 by Judge James H. Faison, III in District Court, Pender County.
