ORDER OF DISMISSAL


Plaintiff, while incarcerated at the Deuel Vocational Institution in Tracy, California ("DVI"), filed a pro se complaint under 42 U.S.C. § 1983 challenging the expected/proposed conditions of his upcoming parole.

Per order filed on April 14, 2004, the court dismissed the complaint with leave to amend within 30 days. However, on April 23, 2004, the post office returned mail from the court to plaintiff as undeliverable, and plaintiff has not provided a current mailing address. Because more than sixty days have passed since the court's mail to plaintiff was returned, the case is DISMISSED without prejudice pursuant to Local Rule 3-11(b).

The Clerk shall close the file and terminate all pending motions as moot.

SO ORDERED.
