Brinkley v. State

District Court of Appeal of Florida, Fourth District
May 17, 1995
654 So. 2d 669 (Fla. Dist. Ct. App. 1995)

Opinion

No. 94-1741.

May 17, 1995.

Appeal from the Circuit Court for Palm Beach County; Richard B. Burk, Judge.

Richard L. Jorandby, Public Defender and Paul E. Petillo, Asst. Public Defender, West Palm Beach, for appellant.

Robert A. Butterworth, Tallahassee and Don M. Rogers, Asst. Atty. Gen., West Palm Beach, for appellee.

With one exception, we affirm the habitual felony offender sentences imposed upon revocation of the probationary terms in cases 92-15179CF, 93-1844CF, and 93-5679CF. As to count II in case 93-1844, the defendant had fully served the sentence before the VOP occurred. We therefore reverse the VOP sentence of 10 years probation on that count.

GUNTHER, FARMER and KLEIN, JJ., concur.
