DECISION & ORDER ON MOTION

Appeal from an order of the Family Court, Richmond County, dated December 12, 2023. Motion by the appellant, inter ala, in effect, to stay enforcement of the order, pending hearing and determination of the appeal. Separate motion by the appellant for leave to prosecute the appeal as a poor person and for the assignment of counsel.

Upon the papers filed in support of the motion to stay enforcement of the order and no papers having been filed in opposition or in relation thereto and upon the papers filed in support of the motion for leave to prosecute the appeal as a poor person and the papers filed in opposition thereto; it is

ORDERED that on the Court's own motion, the appeal is dismissed, without costs or disbursements, on the ground that no appeal lies as of right from a nondispositional order in proceedings pursuant to Family Court Act article 6, part 3 (see Family Ct Act § 1112), and we decline to grant leave to appeal; and it is further, ORDERED that the motions are denied as academic.
