DECISION AND ORDER OVERRULING PLAINTIFF'S OBJECTION TO NOTICE OF DEPOSITION
This case is before the Court on Plaintiff's Objection to Notice of Deposition (Doc. No. 19). The Objection is overruled on the same basis as the Court denied Plaintiff's prior letter request for postponement (See Doc. Nos. 17 18).
In addition, the Court makes the following observations:
1. Since the Decision and Order Denying Motion to Postpone, Plaintiff's physician's office returned the Court's call and advised that the doctor could not speak with the Court to discuss Plaintiff's illness because Plaintiff had not furnished her doctor with a release permitting such conversation sufficient to satisfy the Health Insurance Portability and Accountability Act of 1996.
2. The taking of the deposition of a party, particularly in a case such as this one, is completely standard practice and no inference of intent to embarrass, burden, or oppress Plaintiff can be drawn from the scheduling of such a deposition. The Court renews its offer to preside at the deposition if necessary.
