Brennecke v. Transportation Insurance Company

Supreme Court of Louisiana
Apr 13, 1976
329 So. 2d 431 (La. 1976)

Opinion

No. 57754.

April 13, 1976.

In re: Earl Brennecke, et al, applying for Certiorari, or writ of review, to the Court of Appeal, First Circuit, Parish of Tangipahoa.

Writ refused. The issues are factual. On the facts found by the Court of Appeal there is no error of law in its judgment.

TATE, J., is of the opinion that a writ should be granted in view of the dissenting opinion, to determine whether the trier of fact's conclusion should not have been upheld, since not in manifest error.
