STREET RAILWAYS, § 131boarding passenger injured by jerk, evidence. Judgment for plaintiff was affirmed, where evidence showed that he was attempting to board defendant's street car when it started up, he grabbed the handle and managed to pull himself onto the step, but a sudden jerk of the car caused his leg to be broken, the question whether boarding a moving car in violation of an ordinance constituted contributory negligence was for the jury, and there was no reversible error in the instructions.

Appeal from Circuit Court of Cook county; Hon. DANIEL P. TRUDE, presiding.

Affirmed. Heard in first division, first district, this court at February term, 1940.
