District Court of Appeal of Florida, Fourth District
Mar 8, 2000
755 So. 2d 784 (Fla. Dist. Ct. App. 2000)

Opinion

No. 4D00-0566.

Opinion filed March 8, 2000.

Petition for writ of habeas corpus to the Circuit Court of the Seventeenth Judicial Circuit, Broward County; Peter Weinstein, Judge; L.T. No. 00-791CF10A.

Michael D. Gelety, Fort Lauderdale, for petitioner.

Robert A. Butterworth, Attorney General, Tallahassee, and Daniel P. Hyndman, Assistant Attorney General, West Palm Beach, for respondent.

Petition for writ of habeas corpus is denied.

SHAHOOD and HAZOURI, JJ., concur.

FARMER, J., dissents with opinion.

The record establishes that $250,000 in this case involving a first offense with strong ties to the community is tantamount to no bail at all. I would reverse and remand with instructions to set a reasonable amount of bail.
