In an action to recover the balance of a certain bank account, orders granting plaintiff's motions to vacate, modify and limit notices of examination before trial, and order denying defendant Recktenwald's motion for the framing of issues for submission to a jury and for a jury trial, affirmed, with ten dollars costs and disbursements, the examination to proceed on five days' notice. No opinion. Carswell, Johnston, Adel, Taylor and Lewis, JJ., concur.
