PRESENT:

Petitioner having moved for permission to commence this CPLR article 78 proceeding as a poor person,

Now, upon reading and filing the affidavits of Kevin Patrick Brady sworn to May 23, 2017, and June 6, 2017, and the notice of motion with proof of service thereof, and due deliberation having been had thereon,

It is hereby ORDERED the motion is granted insofar as it seeks permission to file the original CPLR article 78 proceeding in this Court to the extent that petitioner shall file the proceeding within 30 days of the order deciding this motion in accordance with 22 NYCRR 1000.9, and

It is further ORDERED that the motion is denied insofar as it seeks poor person relief on the ground that the facts as set forth by petitioner fail to demonstrate merit to the proceeding.
