Opinion

Submitted October 27, 1939 —

Decided January 25, 1940.

On appeal from the Supreme Court, in which the following per curiam was filed:

"The writ of certiorari in this case brings up for review judgments of the State Board of Tax Appeals reducing the assessments levied on the respondent's hotel property in Bradley Beach, New Jersey, known as the Ocean Royal Hotel. The property was assessed by the borough at $128,700 for each of the two years in question and was reduced by the board to $110,000.

"From our examination of the evidence, we are satisfied that the conclusions of the state board were proper. The building in question, ten years old, is of steel, brick and concrete construction. Its reproduction cost would be over $200,000. It seems, however, not to have been constructed for the most economical use of the space contained within its walls. In fact, the construction appears to have been too expensive for the neighborhood in which the hotel was built. The season is short; the comparatively low rents obtainable and the lack of purchasers at a price much less than the value fixed by the State Board of Tax Appeals lead us to the conclusion that there was ample evidence to justify the reduction made.

"The judgments under review are affirmed, with costs."
