Opinion

No. 04-04-00357-CV

Delivered and Filed: September 8, 2004.

Appeal from the 38th Judicial District Court, Uvalde County, Texas, Trial Court No. 03-07-23,700-CV, Honorable Mickey R. Pennington, Judge Presiding.

Dismissed for Want of Prosecution.

Sitting: Alma L. LÓPEZ, Chief Justice, Catherine STONE, Justice, Paul W. GREEN, Justice.

MEMORANDUM OPINION

The trial court clerk and court reporter notified this court that the clerk's record and reporter's record were not filed because appellants had failed to pay or make arrangements to pay the fees for preparing the records and appellants were not entitled to appeal without paying the fees. On August 2, 2004, we ordered the appellants to provide written proof to this court that either: (1) the fees for preparing the records had been paid or arrangements had been made to pay the fees; or (2) appellants are entitled to appeal without paying the fees. We cautioned the appellants that if they failed to respond within the time provided, this appeal would be dismissed for want of prosecution. See Tex.R.App.P. 37.3(b). Appellants failed to respond to this court's order. Accordingly, this appeal is dismissed for want of prosecution. Costs of the appeal are taxed against the appellants.
